Terms and Conditions for Hiring of Drivers In india.

Booking a Private Driver in India

Bookings can be made up to 12 months in advance and as late as 24 hours before travel (subject to availability). To confirm your booking:

  • You pay the required deposit or advance payment.
  • We send you written confirmation(email/WhatsApp).
  • The driver and vehicle are available for your dates.

Until we confirm your booking, services are not guaranteed. We reserve the right to refuse or cancel bookings if necessary (e.g. safety concerns). If a confirmed driver or vehicle becomes unavailable, we will offer an alternative or a refund.

Payment and Confirmation

All prices are quoted in Indian Rupees (₹) and are subject to change (seasonal demand, fuel costs, taxes, etc.). The final price will be confirmed in your booking. You can pay by bank transfer, UPI, or online payment gateway. We may ask for additional payments (like hotel deposits) as needed. The remaining balance is due before or at the start of your trip. Late payments may delay or cancel your service.

There are no hidden fees: the price covers the driver, fuel, tolls, and parking. (Extras such as GST, sightseeing fees, car permits, interstate taxes, parking fees, or driver food allowance on multi-day trips may be additional.)

Canceling or Changing Your Tour

  • Cancellation by You:You can cancel free up to 48 hours before the start of service. If you cancel between 48–24 hours before, a 50% fee Cancellations under 24 hours (including no-shows) incur 100% charge (no refund). [Adjust these timeframes/fees as needed.]
  • Changes:If you need to change dates or details, contact us ASAP. Changes are subject to availability and may incur extra charges. If a change cannot be made under the same booking, we will treat it as a cancellation (see above) and create a new booking if you wish.

Certain bookings (e.g. flights, trains, some hotels) are non-refundable once paid; any non-refundable costs will be communicated at booking. We strongly recommend travel insurance to cover cancellations or interruptions.

Driver Conduct & Vehicle Safety

Our drivers are experienced, English-speaking, and licensed to drive in India. They maintain safe and polite behavior. You must also behave respectfully and obey all traffic laws. Under no circumstances should you ask the driver to break the law (overspeed, carry extra passengers or luggage, take unauthorized routes, etc.); doing so may result in immediate trip cancellation with no refund.

All vehicles are air-conditioned, clean, and well-maintained. Vehicle type is guaranteed (e.g. sedan, SUV) but the exact model may vary due to availability. The driver will assist with navigation, tolls, and parking but will not perform tourist guiding or other unauthorized services unless agreed. Smoking is not allowed in the vehicle.

Client Responsibilities

You are responsible for:

  • Ensuring legal travel documents(passports, visas, permits) for everyone in your party. We will not be liable for fines or costs if you lack proper documents.
  • Arriving on time at pick-up points. Late arrivals may be treated as cancellations.
  • Respecting the driver’s property and local customs. You may be charged for any damage caused.
  • Following the driver’s instructions for safety.
  • Declaring any medical conditions or special needs in advance.

Insurance and Health

We strongly recommend that all travelers purchase comprehensive travel and health insurance before departure. Insurance should cover trip cancellations, medical expenses, emergency evacuation, and loss of belongings. We are not responsible for any medical issues, accidents, or personal belongings during the trip.

Limitation of Liability and Indemnity

PrivateDriverIndiaTour acts as a tour operator and chauffeur service. We make every effort to provide safe, on-time service, but we limit our liability to the total amount you paid for the booking. We are not liable for loss, damage, delay, or injury caused by events beyond our control, including but not limited to:

  • Flight/train delays or cancellations, traffic jams, road conditions, weather, natural disasters, strikes.
  • Acts of government, customs delays, or other third-party actions.
  • Loss/theft/damage of your personal belongings.
  • Injuries or accidents that are not directly caused by proven negligence of our driver.

You agree to indemnify and hold us harmless from any third-party claims arising from your use of our service (for example, if a driver is sued due to your actions or instructions).

Force Majeure

We will not be liable for failing to provide services if circumstances beyond our control prevent performance. This includes acts of God (floods, earthquakes, pandemics, severe weather), war, civil unrest, government restrictions, or other emergencies. In such cases, we will make reasonable efforts to assist or refund where possible.

Intellectual Property

All content on this site (text, images, logos) is © Private Driver India Tour. You may view and download content for personal, non-commercial use only. Any unauthorized copying, distribution or commercial use is prohibited without our written permission.

Privacy and Data Use

We respect your privacy. Any personal information collected (name, contact, passport details, etc.) is used only for booking and improving our services, in accordance with our Privacy Policy. We do not sell your personal data. By using our site and services, you consent to that policy.

Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of our services will be subject to the jurisdiction of courts in Ghaziabad, Uttar Pradesh, India (or another local court as specified by Indian law).

Amendments, Termination, and Contact

We may revise these Terms at any time; the “Last updated” date at the top will change. Your continued use of services after updates means you accept the new terms. We may suspend or terminate bookings for breaches of these Terms.

  • Q: What is the cancellation policy?
    A:You can cancel for free more than 48 hours before service. If you cancel between 24–48 hours prior, 50% of the tour cost is charged. Cancellations under 24 hours incur 100% charge. No-shows are not refunded. (Flights/trains may have separate fees.)
  • Q: How and when do I pay?
    A:You pay a deposit (usually 20–30%) by UPI or bank transfer when booking. The remaining balance is paid before or when the tour starts (by cash, UPI, or transfer). We send an invoice and receipt for all payments.
  • Q: Can I change my itinerary?
    A:Yes, we can often modify your trip (dates, route, hotels), subject to availability. Changes may incur extra fees (e.g. if hotels become more expensive). Contact us as soon as possible if plans change.
  • Q: Are the drivers insured?
    A:All our drivers are professionally licensed and covered by mandatory vehicle insurance under Indian law. However, insurance only covers accidents in the vehicle. It does not cover personal losses or medical issues; that’s why we recommend personal travel insurance.
  • Q: What if I’m unhappy with the service?
    A:Please tell the driver or contact us immediately. We strive to resolve issues promptly (extra services or partial refunds when justified). Complaints made after the trip cannot be addressed for that booking.
